Terms of Service
These Terms of Service ("Terms") are an agreement between you and ProResin Flooring Solutions, LLC, doing business as SiteQuote ("SiteQuote", "we", "us"). They apply when you use the SiteQuote website at sitequote.net and the app at app.sitequote.net (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you're using the Service for a business, you agree on behalf of that business, and "you" includes the business.
1. The Service
SiteQuote is software for contractors. It gives each contractor an online estimate page where homeowners can get a ballpark price and request a quote, delivers those requests to the contractor as leads, and, on plans that include it, helps contractors estimate jobs, create and send quotes, let customers approve quotes online, and manage customers, referrals and team members. Features vary by plan, as described on our pricing page.
Homeowners can use a contractor's estimate page and approve quotes for free. Section 3 (plans and billing) applies only to contractors; sections 5 and 6A cover what homeowners should know about estimates, visit times and approving a quote.
2. Accounts
- You must be at least 18 and able to enter a binding contract.
- Give accurate information and keep it up to date.
- Keep your password secure. You're responsible for activity under your account, including activity by team members you invite.
- The account owner controls the business account, its billing and its team. Team members use the Service on the owner's behalf.
- Tell us right away at [email protected] if you believe your account has been compromised.
3. Plans, trials and billing (contractors)
- Subscriptions: paid plans are billed in advance, monthly or yearly, and renew automatically until you cancel. Extra team logins are billed on the same schedule as your plan.
- Free trial: new business accounts get a 30-day free trial.
- Plans (Starter, Pro and Business) start without a payment card. To keep your estimate page and leads running after the trial, add a card before the trial ends; it's charged for the plan you've selected when the trial ends. If no card is on file by then, your subscription ends and your estimate page stops taking requests.
- During a trial you can use the features of Business, with the monthly lead limit of the plan you selected.
- Lead limits: Starter (15) and Pro (50) include a set number of leads each calendar month, as shown on the pricing page; Business has no monthly limit. Leads that arrive after you reach your limit are still received, but the homeowner's name and contact details stay hidden until you upgrade or buy extra leads. Unused leads from the monthly allowance don't carry over to the next month.
- Extra lead packs: one-time purchases that add leads to your account. Extra leads are used only after your monthly allowance runs out, and stay on your account while it remains open. Unused extra leads end when your account is closed or your subscription ends, and have no cash value. Lead packs aren't refundable once purchased, except where required by law or for unauthorized charges.
- Leads aren't guaranteed: leads come from homeowners who visit your estimate page. We don't promise any number, quality or value of leads, and we don't screen or verify the people who submit them.
- Changes: you can change plans or billing periods in the app. Changes may be prorated as shown at the time of the change.
- Cancellation: you can cancel any time in Settings → Plan & Billing. Cancellation takes effect at the end of the current billing period, and you keep access until then. Payments already made, including for a partly used billing period, aren't refundable except where required by law. If you believe you were charged in error, email [email protected] within 30 days and we'll look into it. Link may also handle refund requests under its own policies.
- Price changes: we may change our prices. We'll give at least 30 days' notice before a price change affects your subscription.
- Founding Crew (the first 25 businesses): the first 25 businesses accepted into the Founding Crew get SiteQuote Business free for as long as SiteQuote offers it and their account stays active (signed in at least once every 90 days). It covers one business and can't be transferred. In return, each member completes the Founding Crew checklist within 30 days of joining, answers a short check-in each Friday for their first 4 weeks, and reports problems through the app. If the checklist isn't finished within 30 days, the account becomes a Founding Member account (below) instead. Free for life covers SiteQuote's own charges only; third-party costs, such as a phone number and carrier fees for texting once it launches, are billed at cost. The Founding Crew Agreement signed in the app sets out the full terms and controls if it differs from this summary. [Have a lawyer review the final Founding Crew Agreement and this summary before launch.]
- Founding Members (businesses 26 to 100): the 26th to 100th businesses to subscribe get 50% off their plan price for as long as their subscription stays active, including if they switch plans. If the subscription ends, the discount ends with it and isn't restored on a new subscription. Test and internal accounts don't count toward the 25 or the 100.
- Taxes: prices don't include taxes. Sales tax is added at checkout where required.
- Automatic renewal: your subscription renews automatically at the end of each monthly or yearly period, at the price then in effect, and your payment method is charged until you cancel. You can cancel at any time as described below. Before a trial ends, you'll get an email reminder.
- Payments: subscriptions and lead packs are sold through Link, a service of Stripe, which acts as the merchant of record. Link processes the payment, calculates and collects sales tax, sends your receipts and billing emails, and provides payment support. Charges appear on your statement as "LINK.COM*" followed by our name. Link's own terms apply to the payment. You can also manage or cancel your subscription through Link. [Confirm Stripe Managed Payments stays on in live mode; if not, replace this with "processed by Stripe".] If a payment fails, your subscription becomes past due: we and Stripe will retry the charge, and your estimate page, leads and paid features are paused until you update your card and the payment goes through.
4. Your content and data
- You own the information you put into the Service, such as your rates, customers, quotes, logos and documents ("Your Content"). You give us permission to host, process, display and transmit Your Content only as needed to provide, secure and support the Service and to fix and improve how it works. We don't sell Your Content, and we don't use it to train artificial-intelligence models.
- You're responsible for Your Content and for having the right to use it, including any customer information you enter and any logos or documents you upload.
- If you collect information from homeowners or customers through the Service, you're responsible for using it lawfully and in line with what you've told them, including your own privacy policy where required.
- You can export your lists to CSV and download quotes as PDFs at any time.
5. Estimates, prices and quotes
- SiteQuote is a tool. You set your own prices, and you're solely responsible for the prices, quotes, scope, warranties and contracts you give your customers, and for the work you perform.
- Contractor licensing and home improvement laws: you're responsible for following the licensing, registration and home improvement laws where you work. In Pennsylvania that includes registering with the Attorney General if required, showing your registration number on your estimates, proposals, contracts and advertising, following the deposit limits, and using a written contract with the required notices. Make sure your business details in Settings, such as your registration number and street address, are complete and correct, because they appear on your quotes. SiteQuote doesn't check them.
- Default rates, production rates, coverage figures, material lists and market price ranges in the Service are general starting points, not advice or guarantees. Check them against your own costs, suppliers, local conditions and the products you use.
- Ballpark estimates shown to homeowners are approximate ranges, not offers or binding quotes. They may be adjusted for the project's ZIP code using public, area-level cost data; the contractor's final price depends on a site visit.
- Preferred visit times a homeowner picks are requests, not confirmed appointments. The contractor will contact the homeowner to confirm.
- Any agreement for work is between the contractor and their customer. SiteQuote isn't a party to it, and doesn't perform, inspect or guarantee any work.
6. Emails and messages sent through the Service
- When you email a quote or a team invitation through the Service, the message is sent on your behalf. Send it only to people who have asked for it or have a business relationship with you.
- Don't use the Service to send spam, bulk marketing or misleading messages. We may limit how many messages an account can send.
- Review requests: the Service drafts a review request that you send from your own phone or email. You're the sender, and you're responsible for following the texting and email laws that apply to you. When you ask customers for reviews, ask every customer the same way, don't offer anything in exchange for a positive review, and follow the review rules that apply to you, including the FTC's rule on consumer reviews and the review site's own policies.
6A. Online quote approval
- A contractor can share a private link to a quote. Anyone with the link can view the quote, so contractors should send it only to their customer, and customers shouldn't forward it.
- When a customer types their name, ticks the box and clicks Approve quote, they're telling the contractor they accept the estimate and want to go ahead. We record the name typed, the date and time, and when the link was first opened, and show these to the contractor.
- An online approval is not a home improvement contract. Many states require a separate written contract for home improvement work. In Pennsylvania, the Home Improvement Consumer Protection Act (73 P.S. § 517.1 et seq.) requires, among other things, a written contract signed by the homeowner and the contractor that includes the contractor's registration number, a street address, start and completion dates, the total price, the deposit, insurance information and a notice of the homeowner's right to cancel within three business days. The contractor must give the customer a contract that meets the law before starting work or taking any payment.
- A customer can cancel a Pennsylvania home improvement contract within three business days of signing by giving the contractor notice in any form, including by phone; contractors may not require written cancellation.
- The arrangement is between the contractor and the customer only. SiteQuote doesn't take deposits or payments for the work, isn't a party to it, and doesn't perform or guarantee the work.
- Once a quote is approved, the approval can't be changed through the link. Contact the contractor about any changes.
7. Referral programs
Contractors on eligible plans can run their own customer referral programs. The contractor sets the rewards and program terms, and is solely responsible for:
- deciding eligibility;
- paying rewards;
- any tax reporting;
- following the laws that apply to their program.
SiteQuote provides the tracking tools only, and doesn't pay or guarantee any reward.
8. Acceptable use
You agree not to:
- break the law, infringe others' rights, or upload anything harmful, fraudulent or offensive;
- try to access another business's data, or get around plan limits (including monthly lead limits), security or access controls;
- submit fake leads, quote requests, referrals or approvals, or approve a quote on someone else's behalf without their permission;
- post or solicit fake reviews, offer anything in exchange for a review with a particular sentiment, or threaten or pressure anyone to change or remove a review;
- reverse engineer, copy, resell or build a competing product from the Service;
- overload, disrupt or scrape the Service, or use automated means to access it except as we allow;
- share login credentials outside your team logins.
9. Our intellectual property
The Service, including its software, design, estimating methods, default content and the SiteQuote name and logo, belongs to SiteQuote and its licensors. We give you a limited, non-exclusive, non-transferable right to use the Service under these Terms while your account is in good standing. If you send us feedback, we may use it without obligation to you.
10. Third-party services
The Service relies on third-party providers, such as payment processing, email delivery and hosting. Your use of some features may also be subject to those providers' terms. We aren't responsible for third-party services we don't control.
11. Suspension and termination
You can stop using the Service and cancel any time. We may suspend or end your access if you breach these Terms, don't pay, or use the Service in a way that could harm us, other users or third parties. Where reasonable, we'll give notice first. After termination, we'll handle your data as described in our Privacy Policy. If you ask before your account is closed, we'll give you a reasonable chance to export Your Content.
12. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't warrant that the Service will be uninterrupted or error-free, or that estimates, calculations or default figures will be accurate for your jobs.
13. Limitation of liability
To the fullest extent the law allows, SiteQuote won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, arising from or related to the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose, or $100 if you haven't paid us anything.
14. Indemnity
You'll defend and indemnify SiteQuote against claims, losses and expenses (including reasonable attorneys' fees) arising from:
- Your Content;
- your quotes, work or agreements with your customers, including quotes approved online;
- messages you send through the Service and review requests you send to your customers;
- your referral program;
- your breach of these Terms or the law.
15. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Carbon County, Pennsylvania, and you and we consent to their jurisdiction. [Optional: ask your attorney whether to add an arbitration clause and class-action waiver.]
16. Changes to these Terms
We may update these Terms. If we make significant changes, we'll notify account holders by email or in the app at least 15 days before they take effect. If you keep using the Service after the changes take effect, you accept the updated Terms.
17. General
These Terms and our Privacy Policy are the entire agreement between you and us about the Service.
- If any part of these Terms is found unenforceable, the rest stays in effect.
- Not enforcing a provision isn't a waiver of it.
- You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets.
